Terms of Service

1. Agreement to Terms

By accessing or using MentorPath ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Platform. These terms constitute a legally binding agreement between you and MentorPath Ltd.

2. Eligibility

You must be at least 13 years old to use MentorPath. Users under 18 must have parental or guardian consent. Mentors must be enrolled in or have graduated from a recognised UK university.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration. Notify us immediately of any unauthorised use at support@mentorpath.co.uk.

4. Booking & Payments

  • Students pay at the time of booking via Stripe. All prices are inclusive of VAT where applicable.
  • MentorPath retains a platform commission from each booking. The current commission rate is shown to mentors during payout setup.
  • Mentors receive their share of the session fee, paid via Stripe Connect after session completion.
  • Cancellations made more than 24 hours before the session receive a full refund. Cancellations within 24 hours may be subject to a cancellation fee at our discretion.
  • Disputes regarding sessions must be raised within 7 days of the scheduled session date (see Section 14).

5. Mentor Obligations

  • Mentors must keep their profiles accurate and up to date.
  • Mentors must attend all confirmed sessions or provide at least 24 hours' notice of cancellation.
  • Mentors must not solicit payment outside the Platform.
  • Mentors must complete KYC (Know Your Customer) verification before receiving payouts.

6. Student Obligations

  • Students must attend confirmed sessions or cancel with adequate notice.
  • Students must not share session recordings or materials without the mentor's explicit consent.
  • Students must not attempt to contact mentors outside the Platform to circumvent fees.

7. Prohibited Conduct

You must not:

  • Use the Platform for any unlawful purpose.
  • Harass, abuse, or threaten other users.
  • Post false, misleading, or defamatory content.
  • Attempt to circumvent the Platform's fee structure.
  • Upload malware or attempt to compromise Platform security.
  • Impersonate any person or entity.

8. Intellectual Property

All Platform content, branding, and software is owned by MentorPath Ltd or its licensors. You retain ownership of content you upload (profile information, messages) but grant us a non-exclusive licence to display it as part of the Platform service.

9. Limitation of Liability

To the maximum extent permitted by law, MentorPath Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability to you for any claim is limited to the amount you paid to us in the 3 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may close your account at any time by contacting support. Outstanding obligations (e.g. booked sessions) must be resolved before account closure.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We may modify these Terms at any time. We will provide reasonable notice of material changes. Continued use of the Platform after changes constitutes acceptance.

13. Mentor Status and Tax Responsibilities

Mentors who provide services through MentorPath are self-employed independent contractors, not employees, workers, or agents of MentorPath Ltd. By registering as a mentor, you acknowledge and agree that:

  • You are solely responsible for declaring all income earned through the Platform to HM Revenue & Customs (HMRC) and paying any applicable Income Tax and National Insurance contributions.
  • MentorPath Ltd does not operate PAYE, deduct tax, or make National Insurance contributions on your behalf.
  • You are responsible for determining your own VAT obligations if your taxable turnover exceeds the current HMRC registration threshold.
  • You must comply with all applicable tax laws and regulations in your jurisdiction.
  • MentorPath Ltd will provide earnings records upon request but cannot provide tax advice. We recommend consulting a qualified accountant or HMRC directly for guidance.

Payments are processed via Stripe Connect. Your earnings (after the platform fee) are transferred directly to your nominated bank account. MentorPath issues no P60, P45, or payslip, as these are not applicable to self-employed contractors.

14. Dispute Resolution & Chargebacks

Session disputes. If you have a problem with a session (e.g. a mentor did not attend, or the service received did not match what was booked), raise it from the booking page or email support@mentorpath.co.uk within 7 days of the session. We review reports within 24 hours and may issue a full or partial refund, require the mentor to offer a replacement session, or take no action, at our reasonable discretion.

Card chargebacks. If a student disputes a charge directly with their bank or card issuer instead of contacting us first, MentorPath Ltd is responsible for responding to that chargeback and is liable for the disputed amount and any associated fee under our payment processor's terms. To protect the Platform:

  • We ask students to contact us before initiating a chargeback wherever possible, so we can resolve the issue directly and faster.
  • If a chargeback is opened, the related mentor payout may be paused pending the outcome.
  • If the chargeback is decided in our favour, any paused payout is released as normal.
  • If the chargeback is decided against us, the mentor's earnings for that session may be reversed or deducted from a future payout, since the underlying session fee was not ultimately received.
  • Raising a chargeback for a session you attended without first contacting support may be treated as a breach of these Terms.
